Introduction

The Institut Français, a public industrial and commercial establishment located at 8-14 rue du Capitaine Scott, 75015 Paris, registered with the Paris Trade and Companies Register under no. 529 715 922, is the operator responsible for French cultural actions abroad.

As part of its mission to promote French cultural and creative industries internationally, particularly in the field of digital creation, the Institut Français has made available to the public and professionals, in France and internationally, a website that promotes French digital creation which can be accessed at: www.ifdigital.institutfrancais.com

IFdigital provides a showcase for French digital creation professionals who wish to promote their creations and expertise internationally. IFdigital allows French and foreign cultural professionals (cultural venues, broadcasters, producers, programmers, festivals, members of the French cultural network abroad, etc.) to access a wide range of current French digital creation in order to assist them in their programming and in their search for partnerships or co-productions. 


The purpose of these General Terms and Conditions is to determine the conditions for listing on the site and define the terms and conditions for accessing and re-using the content and data on the site.

Disclaimer: The applicable General Terms and Conditions of Use are those that are available online at the time the user logs on. The Institut Français reserves the right to make substantial or non-substantial changes to these General Terms and Conditions of Use at any time without notice. Therefore, users are advised to refer regularly to these General Terms and Conditions of Use to keep abreast of any changes.

A/ Conditions for listing on the site

IFdigital presents creations and professionals in digital creation with detailed, summarised information sheets.

Subject to meeting the listing criteria (see below), French digital creation professionals are encouraged to create files in order to present their profile/organisation and/or their creations using the Creation and Professional contribution forms which can be accessed from a personal account.

1. Request for listing
1.1  Listing criteria

The Professionals and Creations files proposed via the contribution forms must meet the listing criteria specified on the following link.

These criteria are non-exhaustive and may change over time.

The user expressly acknowledges that the Institut Français is under no obligation to list his/her profile/organisation or to list his/her creations on the site. They also acknowledge that the Institut Français, which may call on experts in digital creation if necessary, is the sole judge of the application of the criteria referred to above and is under no obligation to justify the way in which these criteria are applied.

In all circumstances, the final decision to publish an entry on the site, and more generally, any editorial choice relating to the site, shall be the Institut Français' exclusive responsibility.

Furthermore, the Institut Français reserves the right, without giving reasons, to delist any Creation or Professional file that does not or no longer meets these criteria.

1.2 Accuracy of information provided

The user agrees to provide accurate and precise information when filling in the Creation or Professional contribution forms in order to be listed on the site.

The Institut Français may remove any file with inaccurate information from the site.

 

2.   Intellectual property

By validating their listing request, users expressly authorise the Institut Français to reproduce the content entered in the form on IFdigital. 

The authorisation given also includes the right to make any changes to the content entered in the form and reproduced on the site that are necessary to comply with the formats and editorial guidelines applicable on the site. 

Users hereby acknowledge that the changes mentioned in the previous paragraph is not intended to harm the content reproduced. 

 

3.     Guarantee

Users shall refrain from any use of the site that may infringe the rights of third parties and/or the Institut Français.

In particular, the user warrants that: 

  1. the contents reproduced on the site do not include any comments that are abusive, defamatory, sexist, likely to infringe the rights of third parties, contrary to morality, pornographic, racist or violent, or likely to constitute a defence of or calling into question crimes against humanity; 
  2. the content reproduced on the site are free of hidden defects or lack of conformity and do not contain any program such as a virus, Trojan horse, spyware, or other malicious program that could harm the interests of the Institut Français; 
  3. the content transmitted does not infringe the relevant personal data regulations; 
  4. they hold all intellectual property rights such as trademarks, designs and copyrights, of any nature whatsoever, and image rights relating to the content entered in the forms. (Hereinafter the “Guaranteed Rights”)

In this respect, users shall compensate the Institut Français, upon first request, for any conviction, settlement compensation and costs resulting from any proceedings caused by the users’ breach of the Guaranteed Rights, as soon as said proceedings have resulted in an enforceable conviction (final or not) in favour of the Institut Français, or the conclusion of a settlement agreement, or a financial settlement of any kind whatsoever

 

4.  Personal data collected during listing

The Institut français collects the surnames, first names and email addresses of users who complete the Creation and Professional submission forms. 

The Institut français also collects data on persons who have participated in the creative process and other personal data that may feature in the content entered by users when completing the submission forms. 

This data is necessary for the listing of professionals and creations. It is collected, recorded and stored in accordance with the applicable legal provisions, including the provisions of the GDPR.

The Institut français undertakes to implement appropriate technical and organisational measures to protect personal data against alteration, dissemination or unauthorised access.

The Institut français also undertakes to store personal data for no longer than is necessary to achieve the purpose for which it was collected.

Exercise of rights: Anyone whose data is collected by the Institut français has rights of access, modification, opposition, erasure and portability of their personal data. They may exercise these rights at any time by sending an email to the following address: numerique@institutfrancais.com
In the event of difficulties relating to the management of their personal data, all data subjects have the right to lodge a complaint with the CNIL (National Commission for Data Protection and Liberties) or with any competent supervisory authority.

B/ Terms of access and use of the site's contents and data

1. Copyright and reproduction rights
1.1 General structure of the website

The general structure of the website is the exclusive property of the Institut Français.

1.2 Trademarks

The trademarks of the Institut Français and its partners as well as the logos appearing on the IFdigital website are registered trademarks with the INPI and are, as such, protected by industrial property rights.

Any total or partial reproduction of these trademarks or logos from the elements of the site without the Institut Français' express authorisation is strictly prohibited and constitutes an infringement under the Intellectual Property Code.

1.3 Content

All of the material on the IFdigital website (texts, drawings, programs, photographs, names, logos, etc.) is protected by the provisions of the French Intellectual Property Code. Outside France, these elements are protected by copyright in all the signatory states of the Berne Convention.

In accordance with the Intellectual Property Code, any reproduction, representation, modification, adaptation, distribution and/or translation of any of the elements of the IFdigital site, in whole or in part, on any media whatsoever (electronic, paper, etc.) is prohibited without the Institut Français' express prior consent.

Reproduction rights for public or official documents:
In accordance with public intellectual property law and in particular Article L122-5 of the French Intellectual Property Code, "official documents" are freely reusable: press kits and press releases.

Non-commercial re-use, particularly for educational purposes, is authorised on the condition that the information's integrity is preserved and that its meaning, scope and application are not altered, and that its origin and date of publication are specified.

The information may not be used for commercial or promotional purposes without express authorisation of the re-use of public information.

The development of a product or service from the public information to be made available to third parties, whether free of charge or in return for payment, is considered to be re-use for commercial or promotional purposes.

The request must specify the content in question and the publication or site on which it will appear. Once permission has been granted, the reproduction of content must comply with the following principles:

The content of the IFdigital website has been translated into English.

The IFdigital website may provide hyperlinks to websites published by third parties and references to other websites. These links or references do not constitute an endorsement or validation of their content. The Institut Français shall in no way be held liable for the content of said sites and shall not be held liable for any damage or prejudice resulting therefrom. The fact that hyperlinks to other sites are provided to users purely for convenience does not result in any obligation whatsoever on the part of the Institut Français, which has no means of controlling or monitoring the referenced site or its changes and updates.

The creation of hyperlinks to the IFdigital site is free provided that it does not infringe on the material or moral interests of the Institut Français and that it does not create confusion about the source of the services and/or content.

1.6 Accessibility

The site is accessible in accordance with the recommendations of the French Government's General Accessibility Guidelines (RGAA) and the W3C standards. It is compatible with all available browsers. It is accessible to everyone, except in cases of force majeure.

The Institut Français cannot be held liable for direct or indirect, foreseeable and unforeseeable damages such as loss of earnings or profits, loss of data, loss of equipment as well as the costs of repair, recovery or reproduction resulting from the use and/or the impossibility of using the services and content of the site.

Despite the efforts of the website's editorial team, unintentional errors or omissions may occur on the website.

4. Term

The Services accessible from the site shall be provided by the Institut Français for an indefinite period. As such, the Institut Français reserves the right to change the nature of the Services or terminate the activity of its Site at any time.

5. Applicable law and jurisdiction

These general terms and conditions of use are fully subject to French law. Users of the website acknowledge the exclusive jurisdiction of the competent courts of Paris.
